These Terms of Service ("Terms") govern your use of the VoltarisCloud platform, including domain registration, email hosting, website hosting, and related services ("Services"), provided by VoltarisCloud (Pty) Ltd ("VoltarisCloud", "we", "us", or "our"). By signing up or using our Services, you agree to these Terms in full.
You must be at least 18 years old and legally capable of entering into binding contracts under South African law to use our Services. By registering, you confirm that all information you provide is accurate and complete.
VoltarisCloud provides the following Services on a subscription basis:
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice to you.
All prices are quoted in USD and are exclusive of applicable taxes unless stated otherwise. By subscribing, you authorise VoltarisCloud to charge your payment method on a recurring basis according to your chosen billing cycle (monthly or annual).
You may cancel your subscription at any time from your customer portal. Cancellation takes effect at the end of the current billing period — you will retain access to your Services until that date. We do not offer pro-rata refunds for unused time within a billing period, except where required by South African consumer protection law.
Domain registrations are non-refundable once the domain has been registered with the registry, as registration costs are passed directly to the registrar.
Domain names are registered on your behalf through our accredited registrar partner (domains.co.za). You are the registrant of record. VoltarisCloud acts as your reseller and manages the domain on your behalf while you remain our customer. You are responsible for ensuring your registrant contact details are accurate at all times, as required by ICANN and ZACR (.co.za registry) policies.
Domain renewals are handled automatically. If a domain expires due to non-payment, recovery may incur additional fees and cannot be guaranteed.
You agree not to use our Services to:
Violation of this acceptable use policy may result in immediate suspension or termination of your account without refund.
We target 99.9% uptime for hosting services. Planned maintenance will be announced in advance. We are not liable for downtime caused by factors outside our reasonable control, including third-party provider outages, DNS propagation delays, or force majeure events.
Your personal information is processed in accordance with our POPIA Privacy Notice and the Protection of Personal Information Act (POPIA), Act 4 of 2013. We will not sell your personal data to third parties.
All content, software, and systems comprising the VoltarisCloud platform are the property of VoltarisCloud (Pty) Ltd or its licensors. You retain ownership of all content you upload or create using our Services. By using our Services, you grant us a limited licence to host and deliver your content as necessary to provide the Services.
To the maximum extent permitted by law, VoltarisCloud's total liability to you for any claim arising from use of the Services shall not exceed the total fees paid by you in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages including loss of business, loss of data, or loss of revenue.
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts. Nothing in these Terms limits your rights under the Consumer Protection Act (CPA) of South Africa.
We may update these Terms from time to time. We will notify you by email at least 30 days before material changes take effect. Continued use of the Services after the effective date constitutes your acceptance of the updated Terms.
